NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL PROPERTY
WHEREAS, Nellie Pruitt executed a Deed of Trust to Joe Coker, as Trustee, on June 12, 2006, and payable to Whitaker Bank of Corbin, Kentucky, to secure a promissory note in the original principal amount of $72,575.61, which is of record as Instrument No. 200607060001253, in the Register’s Office for Knox County, Tennessee, to which reference is hereby made; and
WHEREAS, David A. Winchester was appointed Substitute Trustee of said Deed of Trust by Instrument dated June 24, 2021, and recorded as Instrument No. 202106300107542, in the Register’s Office for Knox County, Tennessee.
WHEREAS, default having been made in the payment of the indebtedness secured by said Trust Deed, and other provisions of the Trust Deed have been violated, and said holder of said indebtedness has declared the entire amount due and payable, as provided in said Trust Deed, and the Substitute Trustee has been directed to foreclose the Trust Deed, in accordance with the terms thereof, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real property at public auction to the highest and best bidder, for cash, at the Main Entrance of the City/County Building, Main Avenue Level, nearest Main Assembly Room, Knoxville, Knox County, Tennessee, at the hour of 11:00 A.M., on the 15th day of September, 2021, said property to be sold in bar of the equity, and statutory right of redemption.
The property to be sold is described as follows:
Situated in District 5 of Knox County, Tennessee, in Ward 23 of the City of Knoxville, and being Lot 725, Block 61, West Lonsdale Addition to Knoxville, said lot being shown on the map of said Addition of record in Map Book 4, Page 106, in the Register’s Office for Knox County, Tennessee, and being more particularly described as follows:
Beginning on a nail set at a fence post in the East right of way line of Waverly Street; said nail marking a common corner of Lot 725 and 724 and being located 515.4 feet, more or less, in a Southerly direction from the point of intersection of said line of Waverly Street with Western Avenue; thence from the point of beginning, leaving Waverly Street and running with the common dividing line between Lots 724 and 725 and generally along a fence separating said lots, North 81 deg. 56’ 29” East, 149.78 feet to an iron pin (found) in the West line of a 10 foot alley (unimproved); thence, with said line of said alley, South 08 deg. 35’ 46” East, 50.33 feet to an 1.5 inch pipe (found, marking a common corner of Lots 725 and 726; thence leaving said alley, running with the common dividing line between Lots 725 and 726 and generally along a fence separating said lots, South 82 deg. 04’ 00” West, 150.25 feet to an iron pin (set) in the East right of way line of Waverly Street; thence with said line of said street, North 08 deg. 03’ 41” West, 50.00 feet to the point or place of beginning. The foregoing description was taken from the plat of survey dated June 5, 2001, drawing No. L-5911, by Scott W. Umstead Land Surveying, 311 Lynnwood Drive, Knoxville, Tennessee 37918.
Being the same property conveyed to Della C. Slater by quit claim deed from Morgan R. Cheak, dated January 7, 2021, and recorded as Instrument No. 202101150057225, in the Register’s Office for Knox County, Tennessee. Also being the same property conveyed to Della Cheak and Morgan Ray Cheak by quit claim deed from Nellie Pruitt, dated April 4, 2013, and record as Instrument No. 201304100066244, in said Register’s Office.

The terms of the aforesaid sale shall be cash in hand paid to the last and highest bidder, in the event the highest bidder at the foreclosure sale should fail to comply with the submitted bid, the Substitute Trustee shall have the option of accepting the next highest bid in which the bidder is able to comply, or re-advertising and selling the real estate at a second sale. The right is reserved to adjourn the sale from time to time on the day of sale set forth above to another day and time certain without further publication upon announcement of the time set.
The proceeds of the sale will be applied as required by said Deed of Trust.
Said property is to be sold subject to any conditions or easements in the deed in the chain of title, the above referenced exclusions, and subject to any unpaid taxes or liens of record in the chain of title which may have priority over said Deed of Trust, and also subject to any right to redemption that may otherwise exist, including such right by the Internal Revenue Service Special Procedures Staff, or by any taxing authority.
To the best of the Substitute Trustee’s knowledge, information, and belief, there are no Federal or State Tax lien claims filed against the subject property which would require Notice pursuant to the terms and provisions of T.C.A. Sec. 35-5-104 or T.C.A. Sec. 67-1-1433 or 26 U.S.C. Sec. 7425 as of the date of the signing of this Notice.
Other parties having an interest in the above property are as follows: Knox County, Tennessee, and the City of Knoxville, both for delinquent property taxes; and Della Slater, 2646 Powell River Road, Harrogate, TN 37752.
