WHEREAS, by Deed of Trust of record as Instrument No. 201609300020977, in the Register’s Office for Knox County, Tennessee, dated September 13, 2016, and recorded on September 30, 2016, Melanie W. Herron and Billy Wayne Herron, a married couple, trustor, conveyed to 21st Mortgage Corporation, beneficiary, the hereinafter described real property to secure the payment of a Note dated September 13, 2016 (the “Note”) and other indebtedness as described in said Deed of Trust; and

WHEREAS, Tim Williams resigned as Trustee under said Deed of Trust; and Philip L. Robertson was appointed as Substitute Trustee pursuant to a certain Appointment of Substitute Trustee of record as Instrument No. 202305110060484, in the Register’s Office for Knox County, Tennessee; and

WHEREAS, default in the payment of the indebtedness secured by said Deed of Trust has been made; and the entire balance of which having been declared due and payable in accordance with the terms of said Note and Deed of Trust, the owner and holder of said indebtedness, 21st Mortgage Corporation, has directed me, the undersigned, Substitute Trustee, to foreclose said Deed of Trust and to advertise and sell the real property in satisfaction of said debt and the cost of foreclosure, in accordance with the terms and provisions of the Note and Deed of Trust.

NOW, THEREFORE, by virtue of the authority vested in me by said Deed of Trust, I or my duly appointed agent, will on the 16th day of June 2023, offer for sale and sell the following described real property  —  2516 West Gallaher Ferry Road, Knoxville, Knox County, Tennessee, at the usual and customary location at the Knox County Courthouse, Knoxville, Tennessee, beginning at or about 2:00 p.m., to the last, highest, and best bidder for cash, in hand, and free from all rights and equities of redemption, homestead, dower, marital share and all other exemptions and other rights of every kind, including the statutory right of redemption, all of which were expressly waived by the terms of said Deed of Trust. This sale is subject to, however, such prior encumbrances and priority tax liens as may appear of record in said Register’s Office.

The property herein to be foreclosed is described as follows:

Land in Knox County, Tennessee, being all of Lot 1R2, as shown on the map of the Resubdivision of Lot 1, of the William Herron Property, dated July 19, 2006 and filed of record in Instrument No. 200610160032759, Register’s Office of Knox County, Tennessee.

Being a portion of the same property conveyed to William Herron and wife, Alberta Herron, by Warranty Deed from Blanche Herron, dated June 8, 1950, and recorded in Deed Book 834, page 193, Register’s Office of Knox County, Tennessee.

William Herron having died on or about March 30, 1992; see Affidavit of record by Alberta Herron in Instrument No. 200606150105601, said Register’s Office.

Being the same property conveyed to Billy Wayne Herron by Quitclaim Deed from Alberta Herron, dated October 24, 2006 and recorded October 24, 2006 in Instrument No. 200610240035487, Register’s Office of Knox County, Tennessee.

This is improved property with mailing and street addresses of 2516 W. Gallaher Ferry Rd., Knoxville, Tennessee, 37932.

Pursuant to T.C.A. 47-9-604 this sale shall also include a manufactured home described as one (1) 2000 Fleetwood Manufactured Home, with a Serial No. of TNFLY26A57227AV12.

Notice of Sale Concerning County Property

 

Knox County has entered into a contract to sell the parcel of surplus real property below acquired by Knox County in Tax Sale 22.  The parcel number is associated with a property description on file at Knox County Procurement.

 

This property will be sold by Knox County (pending approval of County Commission) absent a bid received from another party within ten (10) days of the publication of this notice which increases the price to be paid for the property by 10% or more.  Any such increased bids must be submitted to the Knox County Procurement Division, 1000 North Central Street, Suite 100, Knoxville, Tennessee 37917 in writing in a sealed envelope identified on the outside referencing a supplemental offer and the parcel number/address of the property by Friday, June 16, 2023 at 4:00 p.m.  Rebids must be signed and include the bidder’s contact information with mailing address, phone number, and current email address.   Bidders acknowledge by submission of their bid that they are current in their respective Federal, State, County, and City taxes.  Bids from bidders who are found to be delinquent will not be considered.
