This cause came to be heard on January 12, 2023, upon the Petition to Sell and Confirm the Sale of Real Property filed by Cindee H. Lambo, Administrator of the Estate of Nancy Leona Carr, deceased, by and through counsel, Fiona F. Hill, filed on December 8, 2022, and an Amended Petition to Sell and Confirm the Sale of Real Property filed on January 11, 2023. Pursuant to T.C.A. §21-1-204, it appearing from the allegations in the Petition and Amended Petition, being duly sworn to, that all identified heirs listed below, any unknown heirs of the Estate of Nancy Leona Carr, and any other persons or parties unknown claiming any right, title, estate, lien, or interest in the real property described in the Petition and Amended Petition, cannot be served with ordinary process of law as their whereabouts cannot with due diligence be ascertained. The Court found the Petition to be well taken, but determined that prior to granting the relief sought to sell the real property identified therein, that Service by Publication was necessary in order divest all right, title, and interest, legal and equitable, in the property to be sold and to vest clean title and interest in each purchaser identified therein. The identified heirs whose whereabouts cannot be ascertained are as follows: Denise Medved Burton, Darrien Gideon, Darlene Keener Fierle, Helen Pope Strausbaugh, Mary Agne Pope Khavari, Shirley Pope Wilson, Jenice Cox Hicks, Sheila Cox, Barbara Ann Williams Ward, Carol Janice Williams Collier Wills, Jack Raymond Williams, Jr., Jacqueline (Jackie) Williams Hicks, Gracie Ellen Williams Blisard Greenway, Katie Marie Sanders, John Phillip Sanders, Steven R. IT IS THEREFORE ORDERED that a copy of this Order shall be published for four (4) consecutive weeks in the Knoxville Focus newspaper to give the opportunity for all identified heirs and any unknown heirs to 1) enter an appearance and provide name, relationship, residence, and contact information, and 2) to file an answer or otherwise defend against the relief sought in the Petition and Amended Petition, within thirty (30) days after the date of the last publication by contacting the Clerk & Master of the Knox County Chancery Court, Probate Division, 400 Main St., Room 125, Knoxville, 1N 37902 and to send a copy of the same to Fiona F. Hill, Esq., Attorney for the Estate of Nancy Leona Carr, 550 W. Main St., Ste. 310, Knoxville, 1N 37902.

IT IS THEREFORE ORDERED that the failure of any unknown heirs not identified in the Petition and Amended Petition, and any other persons or parties unknown claiming any right, title, estate, lien, or interest in the real property described in the Petition and Amended Petition, to file an appearance and provide proof of heirship or interest in the real property will result in a finding by the Court of negating any interest of such unknown heir, person, or party, in the Estate of Nancy Leona Carr and the real property identified in the Petition and Amended Petition.

IT IS THEREFORE ORDERED that the failure to file an answer shall result in the granting of the relief sought in the Amended Petition to sell the real property of the Estate of Nancy Leona Carr and to vest clean title and interest to each purchaser identified therein.
