TERMS: The sale will be for cash. ORNL Federal Credit Union shall have the right to credit bid at the sale and in the event of sale to a third-party, its priority lien shall attach to sale proceeds with its same priority as it had on the real property described herein. Upon closing, ORNL shall be paid in full first out of sale proceeds in exchange for full and complete release of its lien. Any outstanding lien held by Chesney Hills Subdivision shall be paid in full. The sale is subject to any lien(s) that are junior to the mortgage lien of ORNL Federal Credit Union.
The Clerk and Master shall establish a minimum bid to be announced at the sale in an amount determined in his discretion to be in the best interest of all parties under the circumstances at the time of sale. If no bid in excess of the minimum is received from a third-party buyer at the sale, the Clerk and Master shall have the discretion to declare a “no sale.” The Clerk and Master is further authorized to accept an upset bid within ten (10) days following the sale and reopen bidding in accordance with Tenn. Code Ann. § 35-5-110.
